Meetings of the Board of Zoning Appeals are held at 6 PM on the third Thursday each month in the Central Administration Building, Council Chambers, 1755 Town Park Boulevard and are open to the public. Additional meetings may be scheduled for the first Thursday each month when the need arises.
Powers & Duties of the Board of Zoning Appeals include hearing and ruling on variance applications from property owners requesting to vary the terms of city code; and to hear and rule upon Appeals where a property owner alleges that an error in a requirement or determination has been made by a city official in enforcement of the city code.
Applying for a Variance
The Variance Application Form and Instruction Sheet are documents which offer guidance to property owners with regard to completion of the Application Form and required submittals. The non-refundable Hearing Fee is $300.00. Completed applications are submitted through the Green Zoning Office in the city building, 1755 Town Park Blvd.
Residents who are planning a project that they believe will not comply with the code are urged to contact Green Zoning to discuss their plans in detail prior to making application for a Variance. Quite often we can offer suggestions to bring the project into compliance, improve the request, and most importantly make sure the property owner has considered all other alternatives; because if the Board does not approve the Variance request - other alternatives will need to be considered.
What is a Variance?
A Variance is a request by a property owner to, literally, vary from the city code requirements when constructing an improvement to their home or a detached structure on their property. A Residential example would be that the proposed structure will be taller or larger than code permits or closer to the property line than code permits. Examples of a Variance request for a Commercial project may be to permit fewer parking spaces than code requires, permit smaller parking spaces than code requires, or to permit more lot coverage than permitted in the code. The Board may not grant a variance to permit a Use in a Zoning District where that Use is prohibited; to do so would have the effect of re-zoning.
What is an Appeal?
A property owner who feels that a zoning or city official has made an error in a decision or application of the code may file an Appeal to be heard before the Board of Zoning Appeals. The Board will consider the code language and information presented by both sides and make a ruling. If the Board rules with the Applicant or Appellant in the case, the Hearing Fee is refunded.
The members of the Board of Zoning Appeals are appointed to five year staggered terms by the Mayor, per Green City Charter.
